Booking Terms and Rental Agreement
- Third Party Booking Channels may have different cancelation policies and terms than outlined below, and we reserve the right to override the applicable cancellation policy in favour of the guest at our discretion.
- BOOKINGS
- The primary guest is the name of the person on the booking, is the main contact and the primary person responsible for the property and reservation
- The Minimum primary guest age is 18years old.
- For properties with configurable bedding set up - guests will be required to pay a fee if changes to bedding configurations are requested less than 10 days prior to arrival
- Please read the property description relating to guest numbers and bed/bedroom access. Some houses will have a base rate that includes up to a particular number of guests, with access to rooms/bedrooms based on the number booked. When adding extra guests the rooms/beds will be unlocked accordingly. If you have booked for the maximum number of guests the entire house will be available to you.
- Discount codes or special offers must be activated or requested at the time of booking to be redeemed.
- We reserve the right to refuse or cancel and refund in full any booking for any reason.
- If a system error has caused incorrect rates to be calculated or incorrect details to be listed, we reserve the right to amend the rate or details of a property after it has been booked and/or paid online. Guests who may be impacted by such will be given the opportunity to cancel or change their booking with no penalty.
- BOOKING FEES
- The Guest shall pay directly to the Host, the amount detailed during the booking process.
- For Direct Bookings (Booking.com, VRBO, Website, Google, Phone or where payment is facilitated directly by Daylesford BNB), 40% of the payment is due at the time of booking and the balance is due 14 days prior to arrival.
- Payments are taken automatically from the card provided as 40% at the time of booking and balance 14 days prior to arrival.
- Guests may request a change to the inital deposit or scheduled payments by calling the office and making a request. Guests may request the split their payment in up to 4 payments. Daylesford BNB reserves the right to debit the remaining balance 14 days prior to arrival.
- We may cancel a reservation when the balance is not paid in full 14 days prior to arrival and any amount paid shall be retured as a credit less Management fee, to the guest. A credit note voucher will be issued and remain valid for 24 months from the original date of arrival. Guests may use the credit by calling the office to make a booking.
- CANCELATION
- Cancelations can be requested by calling the office or via SMS or by email reply to reservation confirmation message.
- Cancelations requested 14 days before arrival receive a refund of 100% of booking total less Management, Credit card & Transaction fee
- Cancelations requested 7 days or less before arrival receive a refund of 50% of booking total less Management, Credit card & Transaction fee)
- A change of date is considered a cancelation of the booking,
- Bookings become 100% non-refundable when a date change is made 14 days or less prior to arrival
- Management Fee: $100
- Credit card & Transaction fee : (Amount Paid x 1.75%) + (Amount Paid x 2%) + .30
- We reserve the right to waive cancelation fees or offer alternative options at our discretion. A full or partial credit may be offered to guests at the discretion of Daylesford Bnb
- We do not have an extenuating circumstances cancelation policy, covid-19 or pandemic cancelation policy, We strongly urge guests to consider travel insurance or cancel for any reason "CFAR" travel insurance.
- SECURITY DEPOSIT.
- Upon request of Daylesford BNB, the Guest shall be obligated to pay a Booking Security Deposit of no more than either $200 or 10% of the booking total (whichever is greater) on or before the arrival date
- Events may attract a security deposit of no more than either $500 or 25% of the booking total (whichever is greater) on or before the arrival date
- The Security Deposit is for the faithful performance of the Guest under the terms and conditions of this Agreement.
- The Security Deposit shall be returned to the Guest within the State's requirements after the end of the Lease Term less any itemized deductions. This Security Deposit shall not be credited towards any Booking Fees
- HOUSE RULES & GUEST CONDUCT
- The House Rules for the Premises are available on the booking checkout page and guest portal. The house rules include the Check-in and Check-out time, Pet Policy, Smoking Policy, Party and Event Policy and any Additional Rules.
- Pets and animals are not permitted in non-pet friendly Premises. If the Premises is not pet freindly (as indicated on the booking page and guest portal) and the Guest is found to have pets on the Premises, the booking shall be cancelled, the guest shall immediately leave the premises and any Security Deposit shall be forfeited. Pets
At Pet friendly premises guests are expected to clean up after their pets this includes but is not limited to - cleaning up outside after their pet toileting and prevent animals from urinating or defecating inside the house; Provide and use covers for fabric furniture, bedding, couches where animals may lay or spend time; Provide their own drinking/food bowls and not use household dishware for animals; ensure animals are supervised inside at all times; ensure animals are supervised when outdoors on the property to the extent that wildlife is not impacted; ensure compliance with local laws and directives with respect to animals, noise and neighbours. with dog blankets covers. Excess cleaning may be charged for guests who do not clean up after pets or animals they bring on the premisis - Excess cleaning for Pets is listed in Extra Fees section
- Smoking and Vaping (referred to as smoking) on the Premises is prohibited and we resonably suspect that the Guest has been smoking on the Premises, the booking shall be cancelled, the guest shall immediately leave the premises and any Security Deposit shall be forfeited or a a smoking cleanup fee will be due. Smoking cleanup fee is listed in Extra Fees section
- Parties are not permitted, events must be agreed to prior to booking and an event deposit may be requested prior to arrival.
- Guests are expected to promptly communicate any concerns or maintenance issues that arise during their stay. Issues that need attention same day must be communicated by a phone call, subsequent email/sms communication should follow to document any concerns. In order to address such concerns, we will request guests to propose a suitable time for resolution. However, guests agree that the host or a representative may enter the premises to handle urgent matters without requiring written consent from the guests.
- Guests must take care of the premises and return it in the same condition as it was presented
- Guests may only check in to the premises after the check in time on the arrival day, unless otherwise agreed via email, sms or messenger.
- Guests must check out of the premises and provide vacant possession of the premises on the departure day, at or before the departure time unless otherwise agreed via email, sms or messenger
- Guests may be subject to overstay charges if they arrive early or depart late without agreement from Daylesford Bnb. Overstay charge is listed in Extra Fees section
- Guests are responsible for securing the premises on departure
- Guests must turn off all heating, cooling and electrical appliances and extinguish all fires.
- Guest must ensure all keys provided are returned securely to the correct lockbox on departure
- Guests must ensure barbeques, firepits and fireplaces are operated in accordance with fire restrictions and are extinguished upon leaving the house.
- Guests agree to quiet times between 10pm and 7am each day
- OTHER BOOKING TERMS
- Access to the property will only be provided once we have confirmed receipt of total booking fees due.
- The guest does not have the right to sublet the Premises.
- The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.
- The Host has the right to inspect the Premises with prior notice as in accordance with State law.
- Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.
- The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings.
- The Guests shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Host.
- The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.
- The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.
- The Guest agrees to pay all reasonable costs, legal fees, and expenses that shall be made or incurred by the Host enforcing this agreement.
- The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.
- The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.
- Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or one (1) week after departure, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.
- This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.
